Via BoingBoing.net, here is a quick summary of this ridiculous proposal: France may soon enact the worst copyright law in Europe, sneaking it through in a legislative session scheduled for December 22 and 23. (When everyone is away for xmas. Sneaky indeed)

The French Government:
*Wants to ban the distribution of all open source software
*Wants to ban any software that could distribute it
*Wants to SCAN PRIVATE EMAIL to check for "illegal" attachments" such as music files!

This is not only shameful, but simply cannot be allowed to happen. Follow the above boingboing link for the full story.

LOS ANGELES - - The Recording Industry Association of America announced Tuesday that it will be taking legal action against anyone discovered telling friends, acquaintances, or associates about new songs, artists, or albums. "We are merely exercising our right to defend our intellectual properties from unauthorized peer-to-peer notification of the existence of copyrighted material," a press release signed by RIAA anti-piracy director Brad Buckles read. "We will aggressively prosecute those individuals who attempt to pirate our property by generating 'buzz' about any proprietary music, movies, or software, or enjoy same in the company of anyone other than themselves." RIAA attorneys said they were also looking into the legality of word-of-mouth "favorites-sharing" sites, such as coffee shops, universities, and living rooms.

The latest edition of SYSTM, Revision3's excellent videocast, is a hands on primer showing you step by step how to create your own podcast. Anyone thinking about venturing out into the podosphere NEEDS to watch it.

Thanks to Tim of Radio.Speljamr for pointing this out. This really borders on being the last straw.

For some time, the RIAA has been pushing the FCC to impose a copy-protection mandate on the makers of next-generation digital radio receiver/recorders (think TiVo-for-radio).

Now, as reported by Public Knowledge's Mike Godwin, the entire music industry has taken up the cause and is beating the drum in Congress.

Quote: Never mind that digital audio broadcasting is not significantly greater in quality than regular, analog radio. Never mind that it's of vastly less quality than that of audio CDs. In spite of these inconvenient facts, the RIAA is hoping that the transition to "digital audio broadcasting" will provide enough confusion and panic that they can persuade Congress or the FCC to impose some kind of copy-protection scheme or regulation on digital radio broadcast.

In other words, the music industry is basically saying that, where recording from next-generation radio is concerned, government must step in and freeze innovation to ensure that you can never do anything that you couldn't do with an analog cassette deck in 1984. This, despite the fact that Congress specifically approved of digital recording off the radio in the Audio Home Recording Act in 1992. So this is about stopping music fans from doing things that are perfectly legal under copyright law.

It can be very difficult for a ragtag group of merry indie music podcasters, who have day jobs, and don't have money as a group, to come together and pull something off. But sometimes we actually do just that.

Back in the day, pre AMP schism, we had started to form a library of music where our members can draw upon a database of music that has been cleared by the artists without any sort of heinous restrictions or over-reaching licensing. Just a straight up "you can use this and we will credit you and there you have it."

So after much time and effort, we have put it live. We have a lot to put back in there, and a lot of work to do to get it going the way it should, but its a start.

Check out the library if you want to peek. If you are in a band head on over to the signup page and send some music our way. Please read the terms and conditions carefully. We want you to know we respect you.

1: Sonic Playground #2 (Chemical fires and underage boys with guitars) is out, and it's miles ahead of what you heard on DoubleShots. Lynn found her groove. Honest, inspired, and great music.

2: My favorite monkeypup has started his own podcast, "Music For Jerks" and for a 1st episode, it's excellent. It's also worth mentioning that his podcast introduced me to 5 bands I had never heard before on a music podcast. Quite a feat.

The following is for immediate press release worldwide. Though it's voiced through AMP, it represents dozens of other musicpodcasters who still have not been in included in iTunes. If you're one of them, contact me.

Is Apple Thwarting Independent Music Podcasters?

Despite the widespread proliferation of podcasts through Apple�s new iTunes version 4.9, it appears music podcasters that legally distribute independent music are being left behind and effectively locked out of the iTunes podcast directory, which is fast becoming the primary vehicle to find podcasts.

The Association of Music Podcasting (AMP) represents the largest podcasting content group in the world, with forty three members. As of this release, three weeks after the delivery of the latest version of iTunes, thirty four AMP podcast feeds remained unlisted in the iTunes directory. These podcasts were subsequently either listed in the iPodder.org directory that served as the initial basis for the iTunes client ,or were submitted within twenty-four hours of the iTunes release.

It appears Apple has placed procedural obstacles for many older, established podcasts to quickly enter its iTunes directory. Despite that brand new podcast submissions appear to be taking a reasonable amount of processing time (approximately 48 hours), many legacy podcasters have waited weeks without a presence on iTunes.

Moreover, podcasts taken from the original iPodder.org listing are barred from resubmission, with no available option to resolve the issue of podcasts "on hold."

�It�s frustrating,� says Chris MacDonald, owner of IndieFeed Podcasts, founding member and Director of Legal Affairs at AMP. �We�ve been podcasting since mid September of 2004, when this thing really got started. I have thousands and thousands of listeners; yet our fans can�t migrate to iTunes easily. We are losing loyal listeners who aren�t technically savvy or who choose not to run two podcast aggregators at a time. It�s silly to suggest Apple can�t add those feeds to their directory in a reasonable amount of time. It�s also odd that my non-music feeds, which were provided to Apple at the same time, migrated to the iTunes directory in only two days.�

"Corporations are looking to take advantage of the roadwork that the existing podcasting community has created via an unfettered, open-choice format,� says Derrick Oien, President of AMP. Oien is one of the earliest legal music podcasters, going back to the fall of 2004. His show is among many not yet listed in the iTunes directory. Oien adds, �It appears that Apple is more concerned with molding the community to their immediate commercial needs than with embracing this open community and adhering to an effective long term strategy. We have witnessed the early evolution of podcasting at a break-neck pace; partly because podcasting�s open format rapidly adapts to fit the needs of the community at large. Successful corporations will embrace rather than attempt to control this phenomenon. AMP continues to rapidly amass a large and dedicated collective audience, and we are working with people and organizations that approach podcasting in the spirit in which it was conceived. We look forward to working with them. At some point we expect that the support we receive daily from listeners and artists will get Apple's attention."

It would REALLY rock if they were webcasting the video as well. Oh, ok, have some video!

Earlier today I placed a "tipjar" on the website. Don't let it taunt you :-) Give a buck if you like, or just send me a comment, or do nothing, it's completely in your hands. This is the one and only time I'll mention it because I don't wish to throw it in your face on a regular basis.

However, I am compelled to publicly thank Sam Gulino from Tampa, Florida. He contributed something well outside the realm of a "tip" and his generousity almost brought me to tears. Sam, thank you. It means a great deal to me.

This inspired me to tell you all about my small little plan to support the podcasters who entertain me every week, and I can only hope you'll consider adopting the same idea.

Beginning immediately, I will be sending $1 to each of my 5 favorite podcasts. I will repeat this process every month, and that list of 5 may change. It may stay the same. These will be shows that I eagerly look forward to. Shows that are instantly in my ears the second they've finished downloading. Shows I cannot live without.

If you feel the same way I urge you to join me in supporting YOUR favorite 5 shows every month. Five bucks out of your pocket, no sweat. And if enough people adopt this method, hell, it may even help the hosts pay the bills....

Today, the official Podcast Award Nominations have started, and I would sincerely appreciate your nomination of Insomnia Radio in the Music/Radio category.
Nominations begin today, with voting to follow in July, and the creators of the site expect to see over 100,000 hits per day. Talk about anticipation! Winners will be announced during the 2005 Podcast Expo in November, which I'm hoping to attend.
